Terms and Conditions

1. General provisions

These Terms and Conditions (hereinafter referred to as "the Terms") govern the use of the online platform inchiriaza-duba.com / rent-a-van.app (hereinafter referred to as "the Platform"), operated by S.C. Inchiriaza Duba S.R.L., headquartered in Bucharest, Romania.

The Platform operates as an intermediary service (marketplace) connecting vehicle owners ("Owners") with individuals seeking to rent vehicles ("Renters"). S.C. Inchiriaza Duba S.R.L. is not a vehicle rental provider and does not own the vehicles listed on the Platform.

By accessing or using the Platform, including by creating an account, publishing a listing or making a reservation, you confirm that you have read, understood and accepted these Terms in full.

2. Definitions

  • Operator: S.C. Inchiriaza Duba S.R.L., the operator of the Platform
  • Platform: the websites inchiriaza-duba.com / rent-a-van.app and associated services
  • User: any natural or legal person who accesses or uses the Platform
  • Owner: a User who lists one or more vehicles on the Platform for rental
  • Renter: a User who makes a reservation to rent a vehicle through the Platform
  • Vehicle: any van or motor vehicle listed by an Owner on the Platform
  • Listing: the publication of a Vehicle on the Platform by an Owner, including description, photos and price
  • Reservation: a Renter's request to rent a Vehicle for a determined period
  • Commission: the fee charged by the Operator from each completed Reservation

3. Role of the Platform

The Platform acts exclusively as an intermediary between Owners and Renters. S.C. Inchiriaza Duba S.R.L.:

  • Is not a party to the rental agreement between the Owner and the Renter
  • Does not own, operate or inspect the listed vehicles
  • Does not guarantee the availability, technical condition or compliance of vehicles
  • Is not responsible for the behavior of Owners or Renters
  • Facilitates payments, communication and the booking process between parties

4. Account creation and user types

To use the Platform's features, the User must create an account by providing a valid email address, a password and a full name. A phone number is optional but recommended.

A User may act as both an Owner and a Renter, depending on the actions performed on the Platform.

The User is responsible for the confidentiality of their authentication credentials and for all activities carried out under their account. If you suspect unauthorized use, please contact us immediately.

5. Vehicle listings (Owners)

Owners may list vehicles on the Platform subject to the following conditions:

  • All listings are subject to administrative approval before becoming public
  • The Owner must provide accurate and complete information about the Vehicle (make, model, year, capacity, features)
  • Uploaded photos must be recent, clear and accurately represent the Vehicle's current condition
  • The Owner sets the rental price (hourly or daily) and the Vehicle's availability
  • The Owner must have the legal right to rent the Vehicle (ownership or authorization)
  • The Vehicle must have valid insurance and technical inspection

The Operator reserves the right to reject, suspend or remove any listing that does not meet these conditions or that violates these Terms.

6. Booking process

The rental process through the Platform is as follows:

  1. The Renter searches for and selects an available Vehicle, choosing a rental period (hourly or daily)
  2. The Renter submits a booking request through the Platform
  3. A payment hold is placed on the Renter's card via Stripe
  4. The Owner receives a notification and confirms or declines the request
  5. Upon confirmation, the Renter receives the Owner's contact details and the Vehicle pickup address
  6. The Renter picks up the Vehicle at the agreed date and time
  7. Upon completion of the rental period, the payment is finalized

Submitting a booking request does not guarantee its confirmation. The Owner has the right to decline any booking request.

The exact pickup address is shared with the Renter only after the booking is confirmed by the Owner.

7. Renter obligations

The Renter agrees to:

  • Hold a valid driving license corresponding to the Vehicle category
  • Use the Vehicle exclusively for lawful purposes
  • Not sublease the Vehicle to third parties
  • Return the Vehicle in the condition it was received, at the agreed date and time
  • Not transport hazardous, prohibited or illegal materials
  • Not drive under the influence of alcohol or prohibited substances
  • Bear the costs of fueling during the rental period
  • Immediately notify the Owner and the Platform in case of an accident, breakdown or theft

8. Owner obligations

The Owner agrees to:

  • Provide accurate and up-to-date information about the Vehicle
  • Maintain the Vehicle in good technical condition consistent with the listing description
  • Respond promptly to booking requests
  • Hand over the Vehicle in the described condition, at the agreed date and time
  • Hold all necessary legal documents (insurance, technical inspection, proof of ownership or authorization)
  • Honor the price set in the listing
  • Not request payments outside the Platform

9. Commission and fees

The Operator charges a commission of 15% of the total value of each successfully completed booking. This commission is automatically deducted from the Renter's payment before the funds are transferred to the Owner.

Prices displayed on the Platform are expressed in RON (Romanian Lei). The price shown to the Renter includes the Platform commission. The Owner receives the net amount (total price minus the 15% commission).

The Operator reserves the right to modify the commission percentage, with prior notification to Users.

10. Payments and fund transfers

All payments are processed through Stripe Inc. ("Stripe"), a third-party payment service provider. By using the Platform, you also accept Stripe's Terms of Service.

The payment process works as follows:

  • Upon submitting a booking request, the total amount is held on the Renter's card
  • If the Owner declines the request or it expires, the hold is released automatically
  • Upon the Owner's confirmation, the payment is captured (finalized)
  • The Owner receives payment (minus the 15% commission) via Stripe Connect, after the rental period is completed

Owners must set up a Stripe Connect account to receive payments. The Operator is not responsible for processing delays caused by Stripe or the Users' financial institutions.

11. Cancellation policy

Cancellation by Renter: The Renter may cancel a confirmed booking at least 24 hours before the rental start date. In this case, the payment will be fully refunded. Cancellation with less than 24 hours before the start date may result in the retention of up to 50% of the booking value.

Cancellation by Owner: The Owner may cancel a confirmed booking, but repeated cancellations may lead to suspension or removal of the account and listings from the Platform.

No-show: Failure of the Renter to appear at the agreed date and time results in the full forfeiture of the booking amount.

12. Messaging

The Platform provides an internal messaging system through which Owners and Renters may communicate regarding bookings. Users agree to:

  • Not use messaging for illegal, abusive or spam content
  • Not share contact information in order to circumvent payment through the Platform
  • Communicate respectfully and in good faith

Messages are stored on the Platform and may be accessed by the Operator for the purpose of dispute resolution or ensuring compliance with these Terms.

13. Reviews

After a rental is completed, both the Renter and the Owner may leave a review on the Platform. Reviews must be honest, based on real experience and must not contain:

  • False or misleading information
  • Offensive, discriminatory or threatening language
  • Advertising content or spam
  • Personal data of other individuals

Manipulation of the review system (including fake reviews, review exchanges or intimidation to obtain favorable reviews) is strictly prohibited and may result in account suspension.

The Operator reserves the right to remove reviews that violate these rules.

14. Liability and limitation of liability

As the Platform acts exclusively as an intermediary:

  • The Operator is not liable for the technical condition, safety or compliance of listed vehicles
  • The Operator is not liable for direct or indirect damages resulting from the use of a Vehicle
  • The Operator is not liable for disputes between Owners and Renters
  • The Operator is not liable for financial losses caused by cancellations, no-shows or failure by the other party to honor commitments
  • The Operator does not guarantee continuous and uninterrupted availability of the Platform

The Renter is fully responsible for any damage to the Vehicle during the rental period, except for normal wear and tear. The Owner is responsible for the accuracy of listing information and the condition of the Vehicle.

15. Dispute resolution

In the event of a dispute between an Owner and a Renter, the parties are encouraged to resolve the matter amicably. The Platform may facilitate mediation but is not obligated to intervene and does not guarantee a specific outcome.

If a dispute cannot be resolved amicably, it shall be settled by the competent courts in Bucharest, Romania, in accordance with Romanian law.

16. Account suspension and termination

The Operator reserves the right to suspend or close a User's account if:

  • The User violates these Terms
  • The information provided is false or misleading
  • The User engages in abusive, fraudulent or harmful behavior toward other Users
  • The Owner repeatedly cancels confirmed bookings
  • The User attempts to circumvent the commission through off-platform transactions

The User may request account closure at any time by contacting the Operator at contact@inchiriaza-duba.com. Account closure does not affect financial obligations already incurred.

17. Force majeure

Neither party shall be liable for the non-performance of contractual obligations in the event of a force majeure event, in accordance with applicable Romanian legislation.

18. Personal data protection

The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR). Full details are available in the Privacy Policy.

19. Intellectual property

The content of the Platform, including texts, design, logos and software, is the property of S.C. Inchiriaza Duba S.R.L. and is protected by copyright law in Romania and the European Union. Reproduction, distribution or modification of this content without the written consent of the Operator is prohibited.

By listing a Vehicle on the Platform, the Owner grants the Operator a non-exclusive, free and revocable license to use the provided photos and descriptions for the purpose of promoting the listing on the Platform and in its marketing materials.

20. Modification of Terms

The Operator reserves the right to modify these Terms at any time. Modifications take effect on the date of publication on the Platform. Continued use of the Platform after publication of modifications constitutes acceptance of the new Terms. Users will be notified by email regarding significant changes.

21. Applicable law and jurisdiction

These Terms are governed by the laws of Romania. Any dispute arising from or in connection with these Terms shall be resolved by the competent courts in Bucharest, Romania.
